Please read these Terms carefully. By using our website, requesting an estimate, or entering into a service agreement with NRW Landscapes, you agree to be bound by these Terms and Conditions. These Terms govern your use of our website and your relationship with us as a service provider.
These Terms and Conditions ("Terms") govern your use of the NRW Landscapes website ("Website") and all services provided by NRW Landscapes ("Company," "we," "us," or "our"). By accessing or using our Website, submitting a contact or quote request form, or entering into any verbal or written service agreement with NRW Landscapes, you ("Customer," "Client," or "you") acknowledge that you have read, understood, and agree to be bound by these Terms.
If you do not agree to these Terms, please do not use our Website or engage our services. We reserve the right to modify these Terms at any time. Changes become effective upon posting to the Website. Your continued use of the Website or engagement of our services after changes are posted constitutes acceptance of the revised Terms.
NRW Landscapes provides residential and commercial landscape construction and site work services in Pittsburgh, Pennsylvania and the surrounding greater Pittsburgh area. Our services include but are not limited to:
Services are subject to availability and scheduling. NRW Landscapes reserves the right to decline any project at our discretion. We do not guarantee that all services will be available in all geographic areas or at all times.
NRW Landscapes provides free, no-obligation estimates for all services. Submitting a quote request through our website does not obligate you to engage our services, nor does it obligate us to perform the work. An estimate is not a binding contract.
All written estimates are valid for 30 days from the date of issuance unless otherwise noted on the estimate. After 30 days, NRW Landscapes reserves the right to revise the estimate based on current material costs, labor rates, and site conditions.
Estimates provided without an in-person site visit are preliminary and subject to revision upon actual inspection of the property. The final quoted price may differ from an initial phone or online estimate based on site conditions, property size, access limitations, soil conditions, or other factors not determinable without a physical assessment.
Estimates cover only the work specifically described. Any work beyond the stated scope will be quoted separately and requires your written or verbal authorization before proceeding. We will make reasonable efforts to notify you of unforeseen conditions or scope changes before performing additional work, except in emergency situations where your property could be damaged by inaction.
For ongoing services (e.g., seasonal snow removal), service may be established verbally or in writing. You agree that scheduling our crew for the first visit constitutes acceptance of the rates quoted and our standard terms.
For one-time or project-based work (e.g., landscape installation, hardscaping, grading), a written proposal or work order will be provided prior to commencement. Work will not begin until you have approved the scope and pricing, either in writing, by email, or by authorizing the work verbally with confirmation documented by NRW Landscapes.
As required by Pennsylvania law, any home improvement contract valued at $500 or more must be in writing and include the elements required by the Pennsylvania Home Improvement Consumer Protection Act. See Section 16 for details.
Payment for routine maintenance services (mowing, edging, etc.) is due within 14 days of the date of service, unless otherwise agreed in writing. Invoices will be sent electronically or delivered at time of service.
For project-based work (landscape construction, installations, hardscaping, etc.):
Note on Deposits: Under Pennsylvania's Home Improvement Consumer Protection Act (HICPA), we are prohibited from requiring a deposit greater than one-third (1/3) of the total contract price before work begins on residential properties.
We accept cash, check, and electronic payment methods as communicated at the time of invoicing. Checks should be made payable to NRW Landscapes.
Invoices not paid within 30 days of the due date are subject to a late fee of 1.5% per month (18% annually) on the outstanding balance, or the maximum rate permitted by Pennsylvania law, whichever is less. NRW Landscapes reserves the right to suspend ongoing services for accounts with unpaid balances overdue by more than 30 days, without liability for any resulting condition of your property.
A returned check fee of $35.00 will be assessed for any payment returned by your financial institution for any reason. We reserve the right to require cash or certified payment for future invoices after a returned check event.
Accounts unpaid after 60 days may be referred to a collection agency or attorney. You agree to pay all reasonable costs of collection, including attorney's fees, in the event legal action is required to collect amounts owed.
You may cancel recurring services (e.g., snow removal) at any time by providing at least 48 hours' notice prior to your next scheduled service. Cancellation with less than 48 hours' notice may result in a cancellation fee of up to $50.00 or the cost of one scheduled visit, whichever is less, to cover crew scheduling and mobilization costs.
Cancellation of an approved project-based contract after materials have been ordered or work has commenced will result in forfeiture of the deposit paid and payment for all work performed and materials purchased to the date of cancellation. If cancellation occurs before materials are ordered and before work has begun, your deposit will be refunded in full, subject to your Pennsylvania Right to Cancel under Section 7.
NRW Landscapes reserves the right to cancel or reschedule services due to unsafe weather conditions, equipment failure, crew illness, or other circumstances beyond our control. We will make reasonable efforts to notify you as soon as possible and reschedule at the earliest available time. No cancellation fee will be assessed to you in these situations.
YOUR RIGHT TO CANCEL: Under the Pennsylvania Home Improvement Consumer Protection Act (HICPA, 73 P.S. § 517.7) and the FTC's Cooling-Off Rule (16 C.F.R. Part 429), if this transaction was solicited at your home or at a location other than our regular place of business, you have the right to cancel this contract without penalty or obligation within THREE (3) BUSINESS DAYS from the date you sign the contract or the date you receive a copy of this notice, whichever is later.
To cancel, you must notify NRW Landscapes in writing before midnight of the third business day. You may use any written method, including email to nrw.landscaping@gmail.com or a signed written notice mailed or delivered to our business address. If you cancel, any deposit you paid will be refunded within 10 business days, and any materials delivered to your property will be retrieved at our expense within 20 business days.
This right to cancel applies to home improvement contracts as defined under HICPA. For commercial service agreements, separate cancellation terms will be stated in the written contract.
To enable NRW Landscapes to perform services safely and effectively, you agree to the following responsibilities prior to each scheduled service visit:
You agree to provide NRW Landscapes and its crew members with safe, unobstructed access to the areas of your property where services are to be performed on the date(s) scheduled. This includes ensuring gates are unlocked, vehicles are moved from areas to be serviced, and access routes to the property are clear. If access is denied or obstructed on a scheduled service date, a service call fee may apply.
You are solely responsible for the safety of your pets, children, and any other individuals on your property during service visits. Please ensure that pets are secured indoors or otherwise confined away from work areas. NRW Landscapes is not responsible for injuries to pets or individuals who enter active work areas during service.
You agree to disclose to NRW Landscapes, prior to commencement of work, any known hazards on or beneath the property, including but not limited to: underground irrigation systems, buried cables or conduits, drainage systems, septic systems, low-voltage lighting, wells, French drains, tree roots, unstable ground, chemical applications, or any other conditions that could affect the safety of our crew or the outcome of the work.
NRW Landscapes is not responsible for damage to undisclosed or unmarked underground systems, structures, or hazards.
Prior to mowing or other ground-level services, you agree to remove from the service area any debris, toys, dog waste, garden hoses, irrigation heads not marked for our awareness, decorative items, and any other objects that could be damaged by or cause damage to equipment.
You represent that the information you provide to NRW Landscapes regarding the property (ownership or authority to authorize work, property boundaries, conditions) is accurate and complete. If you are not the owner of the property, you represent that you have authority from the owner to contract for the services described.
Pennsylvania law (73 P.S. § 176 et seq., the Underground Utility Line Protection Law) requires that excavation work — including digging, grading, trenching, and any work that disturbs the ground to a depth greater than routine mowing — be preceded by notification to PA One Call (811) at least three (3) business days before the work begins.
For any service that involves ground disturbance beyond routine mowing and maintenance, NRW Landscapes will request that you or we jointly contact PA One Call (811) to have underground utilities marked. We reserve the right to delay any digging work until utility marking is confirmed.
NRW Landscapes is not responsible for damage to underground utilities, lines, or systems that were not properly marked by the utility owner or their agent following a valid One Call notification.
If you are aware of private underground utilities (irrigation, landscape lighting, private drainage systems) that are not covered by PA One Call, you must mark these yourself or provide us with accurate as-built drawings prior to any ground-disturbing work.
Landscape construction and outdoor services are performed outdoors and are subject to weather conditions. NRW Landscapes reserves the right to reschedule services when conditions make work unsafe, impractical, or likely to result in damage to your property or our equipment. Conditions that may result in rescheduling include:
We will make reasonable efforts to notify you of any weather-related rescheduling and will reschedule at the next available opportunity. No penalty or fee will be assessed for weather-related rescheduling by either party.
Lawn outcomes (growth rates, color, recovery from stress) are affected by weather conditions beyond our control, including drought, excessive rainfall, frost, and temperature extremes. NRW Landscapes does not guarantee specific lawn appearance outcomes when weather conditions are outside of normal seasonal ranges for Western Pennsylvania.
NRW Landscapes is not responsible for pre-existing damage to your property, including but not limited to: deteriorated lawn areas, existing drainage issues, unhealthy plants or trees, fence damage, pre-existing concrete or pavement cracking, or other conditions present before our services commenced. We will make reasonable efforts to document and notify you of any pre-existing conditions we observe before beginning work.
Certain minor impacts are inherent to the nature of landscape construction services and do not constitute damage. These include: minor tire marks from equipment on turf (which typically recover within days), minor soil disturbance during grading or excavation, temporary disruption of ground cover during installation, and minor surface marks near construction areas. These are not covered by any damage claim.
If you believe NRW Landscapes has caused damage to your property as a result of our operations, you must notify us in writing within 72 hours of the service visit in which the damage allegedly occurred. Failure to notify us within this period may limit our ability to investigate the claim and may affect your ability to recover for the alleged damage.
We will investigate all reported claims in good faith. Where NRW Landscapes is found to have caused damage through our negligence or error, we will, at our option, repair the damage, replace the damaged item, or provide a credit toward future services. Our liability for any single damage claim is limited as described in Section 14.
As stated in Section 8.3, NRW Landscapes bears no responsibility for damage caused by undisclosed or unmarked underground systems, hazards, or structures. By engaging our services, you agree to indemnify NRW Landscapes for any claims arising from damage to undisclosed underground utilities, systems, or structures.
NRW Landscapes warrants that all services will be performed in a professional and workmanlike manner consistent with industry standards for the greater Pittsburgh, Pennsylvania region. If you are not satisfied with the quality of work performed, you must notify us within 7 days of the service date. We will return to correct any deficiencies in our workmanship at no additional charge.
For landscape installations involving plant materials (trees, shrubs, perennials, annuals, sod), NRW Landscapes provides a limited 30-day warranty from the date of installation. This warranty covers plant mortality caused by improper installation technique. It does not cover plant loss due to:
For hardscape installations (walls, patios, pavers), NRW Landscapes provides a limited 1-year warranty on labor and installation workmanship. Manufacturer warranties on materials pass through to you as the property owner. This warranty does not cover damage resulting from improper customer use, ground movement beyond normal seasonal frost heave, or drainage conditions that were undisclosed at the time of installation.
EXCEPT AS EXPRESSLY SET FORTH IN THIS SECTION, NRW LANDSCAPES MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
NRW Landscapes maintains general liability insurance and workers' compensation insurance as required by the Commonwealth of Pennsylvania. Our insurance covers accidental property damage and bodily injury caused by our negligence during the performance of services.
Proof of insurance is available upon written request and will be provided to you within a reasonable time. Our coverage does not replace your homeowner's or property insurance, and we recommend that all property owners maintain adequate insurance for their property at all times.
Important — Please Read Carefully. This section limits the total amount of money NRW Landscapes can be required to pay you under any circumstances.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE PENNSYLVANIA LAW, NRW LANDSCAPES' TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR OUR SERVICES — WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE — SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID NRW LANDSCAPES FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM IN THE 30 DAYS PRECEDING THE CLAIM, OR (B) $500.00.
IN NO EVENT SHALL NRW LANDSCAPES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF BUSINESS OPPORTUNITY, LOSS OF USE OF PROPERTY, OR COSTS OF REPLACEMENT SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Some states or jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you in its entirety. In such jurisdictions, our liability will be limited to the maximum extent permitted by applicable law.
Nothing in these Terms limits liability for: (i) death or personal injury caused by NRW Landscapes' gross negligence or intentional wrongdoing; (ii) fraud or willful misrepresentation; or (iii) any other liability that cannot be excluded or limited under Pennsylvania law.
You agree to defend, indemnify, and hold harmless NRW Landscapes, its owners, employees, agents, and contractors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or related to:
NRW Landscapes operates in compliance with the Pennsylvania Home Improvement Consumer Protection Act (HICPA), 73 P.S. § 517.1 et seq., which governs home improvement contracts entered into with residential property owners in Pennsylvania.
NRW Landscapes is registered as a Home Improvement Contractor with the Pennsylvania Attorney General's Bureau of Consumer Protection. You may verify our registration at www.attorneygeneral.gov or by calling the PA AG's office.
As required by HICPA, written contracts for home improvement work valued at $500 or more will include:
NRW Landscapes will not: demand a deposit of more than one-third of the contract price before beginning work; abandon a project without justification; misrepresent the work to be performed; use fraudulent or deceptive practices; or engage in any conduct prohibited by HICPA or the Pennsylvania Unfair Trade Practices and Consumer Protection Law (UTPCPL), 73 P.S. § 201-1 et seq.
If you believe NRW Landscapes has violated HICPA or the UTPCPL, you may file a complaint with the Pennsylvania Office of Attorney General, Bureau of Consumer Protection, at www.attorneygeneral.gov or by calling 1-800-441-2555.
All content on the NRW Landscapes website — including text, graphics, logos, images, design elements, and the compilation of such content — is the property of NRW Landscapes and is protected by applicable copyright, trademark, and other intellectual property laws. The NRW Landscapes name, logo, and brand marks are proprietary to NRW Landscapes.
You may view, print, and download content from our Website for personal, non-commercial use only. You may not reproduce, distribute, publicly display, modify, or create derivative works from any Website content without our prior written consent.
Nothing in these Terms grants you any right, title, or license to use our trademarks, service marks, logos, or trade dress.
These Terms and any dispute arising out of or related to them or our services shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions.
Any legal action or proceeding arising out of or relating to these Terms or our services shall be brought exclusively in the state or federal courts of competent jurisdiction located in Allegheny County, Pennsylvania. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.
Before initiating any legal action, you agree to contact NRW Landscapes and make a good-faith effort to resolve the dispute informally. Please contact us at (412) 328-4620 or nrw.landscaping@gmail.com to describe the issue and your proposed resolution. We will respond within 10 business days. This informal dispute resolution requirement does not apply to claims involving urgent injunctive relief.
Nothing in these Terms prevents either party from bringing an eligible dispute in the appropriate Pennsylvania Magisterial District Court (small claims court) rather than the Court of Common Pleas, where jurisdiction permits.
These Terms, together with any written service agreement, proposal, or contract signed by both parties, constitute the entire agreement between you and NRW Landscapes with respect to the subject matter herein, and supersede all prior or contemporaneous understandings, representations, or agreements, whether oral or written.
If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
The failure of NRW Landscapes to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of NRW Landscapes to be effective.
NRW Landscapes operates as an independent contractor. Nothing in these Terms creates an employment, partnership, joint venture, agency, or franchise relationship between you and NRW Landscapes. Our employees and subcontractors are under the direction and control of NRW Landscapes, not you.
NRW Landscapes shall not be liable for any failure or delay in performance of our obligations under these Terms arising from causes beyond our reasonable control, including but not limited to: acts of God, natural disasters, severe weather events, labor disputes, government orders, pandemics, supply chain disruptions, or equipment failures caused by third parties.
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. NRW Landscapes may assign these Terms or any rights hereunder without restriction.
You consent to receive communications from NRW Landscapes electronically (by email, text, or through our website) for purposes related to the services you have requested. Electronic communications from NRW Landscapes constitute legally valid and enforceable written communications to the extent permitted by applicable law.
